This privacy notice sets forth the terms and conditions under which EON Assets, S.A.P.I. de C.V., commercially known as “EON Assets” (hereinafter “EON Assets” or the “Controller”), with its registered address located at Santa Fe Avenue #170, office 04-04-02, Álvaro Obregón, Mexico City, Postal Code 01376, in its capacity as the Controller, will process the personal data pertaining to you in order to protect your privacy and your right to informational self-determination, pursuant to the Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) (the “Law”), its regulations, as applicable, and any other relevant applicable legal provisions, including, without limitation, the Privacy Notice Guidelines that may be issued from time to time (collectively, the “Applicable Regulations”), and in accordance with international standards required for the security and protection of our users’ information.
EON Assets collects and processes your personal data, which include, without limitation, the following:
i) General Identification and Contact Data: Full name, signature, date and place of birth, age, nationality, gender, marital status, full address (home or work), telephone number (home or work), mobile phone number, email address (personal or work), photograph, Unique Population Registry Code (Clave Única de Registro de Población) (CURP as per its acronym in Spanish), corporate data (if applicable), and immigration status (if applicable), as well as any other related data applicable according to the place of origin.
ii) Data to Access EON Assets’ Online Services: Username and password created by you on our Website in order to access our Services, as well as any other data necessary to register as a user on our Website.
iii) Tax Data: Federal Taxpayer´s Registry (Registro Federal de Contribuyentes) (RFC as per its acronym in Spanish) number, tax domicile, tax regime, tax returns, tax withholdings, tax credits, tax receipts and tax disputes, as well as any related data applicable to the place of origin or substituting any of the aforementioned elements.
iv) Financial or Asset Data: Account holder name, bank account or card number, standardized bank code (Clave Bancaria Estandarizada) (CLABE as per its acronym in Spanish) and bank of origin, financial statements, letters of origin of funds, as well as any other data required to identify the payment methods the Data Subject will use to fulfill payment obligations through the Website.
v) Personal Data Collected by Automatic Data Capture Tools on the Website (cookies, web beacons, links in emails): Browser type, language, session identifiers with the Website, passwords used to access the Website, access times, IP address, operating system of the device used to access the Website, and interaction with our emails and Website.
vi) Personal Data from Public Sources and Transfers with Consent: Data originating from public registries, directories, social networks, and other lawful publicly available sources, as well as Personal Data shared with us by third parties to whom you have previously granted authorization.
vii) Personal Data from Social Networks: EON Assets may collect and process Personal Data and information you have shared on social media platforms (such as Facebook®, Twitter®, LinkedIn®, among others), including information designated as “public,” pursuant to the applicable terms of use and policies of such platforms.
At EON Assets we process your personal data for the fulfillment of the purposes of the services we provide you within this website, such as managing your investment account; AML/KYC regulatory compliance and validation processes, carrying out the transactions initiated by the Data Subject and processing the payments, capital calls, distributions, fees, and invoices or any other tax documentation related to your investment; analyzing, verifying, and/or corroborating that the data subject has the legal capacity and sufficient authority to enter into a contract with the Controller or to bind themselves through another legal instrument with the Controller with respect to the financial products or investment vehicles they subscribe to; analyzing, verifying, and/or corroborating that the payment method or funding source provided by the data subject is legitimate or has sufficient funds to comply with the capital commitments or payment obligations arising from the financial products or investment interests acquired or subscribed, as applicable, through the Controller’s services; maintaining the investment history in our database in order to resolve any questions through investor relations support; maintaining an investor identification file regarding the data subject; managing your requests and responding to your questions or comments; sending you confirmations and updates regarding your investment, as well as any relevant information related thereto, which may be sent via email, SMS, WhatsApp, or any other instant messaging service to the contact details you have provided; complying with our legal obligations, including cooperating with any request from public authorities authorized by law. As well as taking the judicial or extrajudicial actions that may be necessary to enforce the agreements entered into by the data subject through EON Assets’ services; providing information to third-party service providers involved in the administration of the investment fund, or in the provision of financial, legal, tax, audit, custody, technology, or compliance services related to the fund’s operations; and other purposes compatible with the foregoing, as well as carrying out the activities and actions aimed at fulfilling the obligations arising from any commercial and/or legal relationship we establish with you and/or with third parties and which we consider primary or necessary purposes, which include: (i) fulfilling the corporate purpose of EON Assets; (ii) AML/KYC regulatory compliance and validation processes; (iii) managing your investment transactions, including capital contributions, subscriptions, redemptions, transfers, and any other related investment services, as well as managing your transaction history, amendments, withdrawals, cancellations, and any other operations associated with such investment services and related activities; (iv) participating in chats and/or discussion forums; (v) sending notifications of offers, notices and/or advertising, promotional, commercial prospecting, or marketing messages, through printed and electronic media; (vi) using the various services available on EON Assets´ website; (vii) allowing the management, administration, and security of your personal data; (viii) maintaining physical, electronic, and procedural safeguards for your personal data in accordance with the Applicable Regulations, and (ix) complying with applicable legal requirements.
